Сообщений: 16974 (просмотреть) 		У кого есть достоверная информация? Проверяют ли в посольстве криминальную историю человека? В их полиции на меня было дело по шоплифтингу. Из информаци обо мне у них мое имя и отпечатки пальцев. Номера SSN и паспорта у них нет. Может даже не знают что я был там по программе. В результате разбирательства заплатил штраф. Доработал нормально и улетел домой в срок. По всей видимости в посольстве и спонсорской организации об этом не узнали - если бы узнали - депортировали. Как думаете будут проверять если я подам на визу (не J1 а какую нибудь другую). Большое спасибо!

All criminal information from the courts in the USA are entered into the FBI criminal database and when they run your name a "hit" will be entered and they will find your criminal charge. Then not only will you be in trouble trying to enter the USA with your criminal charge but you will ALSO be in trouble for lying on your DS-156 about not having any criminal problems in the USA.
I suggest the following:
Contact your former criminal lawyer in the USA to see about having the charge removed from your criminal record. If you had a public defender, then you will probably need to hire another criminal lawyer to have this done. THEN you can come back without any embarassing problems and waste of your money.

Скажите, имеет ли значение то, что я заплатил штраф и убытки магазину. Возможно ли что моих данных нет в базе данных ФБР? Дело в том, что как я понимаю мне инкриминировали что-то вроде административного правонарушения(peddy crime).
C какой долей уверенности можно говорить об успешности предлагаемых Вами методов? Какова стоимость данной услуги? Спасибо!

that's not how it works.
all criminal information in the USA is sent to FBI. (remember the place where Mulder and Scully worked?)
whenever you apply for a visa in any country, one of the steps is that they will complete is submitting your name to the FBI database. Some day in the future, perhaps they will submit fingerprints, but that's not happening right now. If your name is Ivan Ivanovich and you were arrested for shoplifting then any time Ivan Ivanovich applies for a visa, they will get a "hit" on his name, and they will ask Ivan Ivanovich if he is the same. If they don't believe the answer, they can have the fingerprint card electronically sent to the embassy to compare.
Why don't you have this taken off your criminal record in the USA?
This would be the easiest.
I can only help you if it's in Washington State.
Otherwise, you will need to find a lawyer in the State where you were arrested.

Man... you spent time in immigration detention? Damn! I bet that sucked... However, I'm certain that you understand a lot more Spanish that you did before your arrest. )))

The best thing for you to have done when you were arrested would have been to hire a lawyer. This lawyer would then have made some arrangement to pay the store directly and to have your criminal case dismissed. Then you wouldn't have had to sit in criminal and immigration jail.

But since you are telling me that you had to sit in jail on a simple shoplifting charge, this tells me that you didn't even have probably 500-1000 USD to pay the "bail" to get out. If you couldn't afford to pay to get out on bail then certainly you couldn't have afforded a lawyer. This is always some difficulty if your family name is not Gusinsky or Abromovich... ))

So, here's what I recommend...

contact me at my temporary email address: lawjob @ moscow.com
We can make arrangements to check the FBI directly to see if your information exists there. If you are close to Moscow I can arrange to send an FBI fingerprint card to you. You should then find some friendly militsiyioner who will agree to professionally and accurately put your fingerprints on this card for less than 30 rubles. The cost for the FBI to search all its records and to send any report is not high. It's equivalent to buying me a beer at a nice club every friday and saturday for one month...

If the FBI does have this report, then there are ways that it can be removed. I may have to find a lawyer for you in the state where you got "busted", but it can be done. Meanwhile you should take a second job or arrange to sell your grandfather's Volga-21 to pay for this... (joke)

Also, I can easily obtain a full copy of your deportation file for you from ICE (Immigration and Customs Enforcement). This might provide further information...

Also, (TO EVERYONE)...whenever you are going to break the law in a foreign country, ALWAYS ALWAYS first have a close boyfriend/girlfriend who is a citizen of that country that you are sleeping with that loves you. This person will hopefully save your ass!

Remember, it's just as easy to love a U.S. citizen while you are in America as it is for you to love a fellow J1 (also, it will improve your English much more quickly!!!)
